Terms & Conditions of Membership

These terms and conditions form the basis of the contract through which we will deliver a service to you as a member. On applying for membership, you are agreeing to these terms and conditions and you are providing us with the appropriate consent to handle your personal information in accordance with The Data Protection Act (1998) and The General Data Protection Regulation (2018).

1. Membership applications

1.1 New membership applications will be accepted via our website and telephone only. Whether you submit an application online via our website or telephone, you are making an offer to subscribe to us which, if accepted by us, will result in a legally binding contract.

1.2 The legally binding contract is formed on the date we collect your first membership payment, whether in part (for Direct Debit payments) or in full.

1.3 Membership is subject to successful accreditation against to our published entry criteria, which we reserve the right to change and / or amend at any point. The latest version of our criteria will be published online and supersedes printed versions.

1.4 Membership is determined based on the information you supply at the point of application (& updates we receive during your membership with us). Failure to provide accurate information may result in your membership being terminated.

1.5 The offer of membership is made at the discretion of The BiKBBI. The BiKBBI reserves the right to refuse membership and are not obliged to provide the applicant with a written reason. In the event membership is refused, any membership fee (whether in part, or full) paid by the applicant will be refunded at the point of refusal.

1.6 An application does not constitute membership to The British Institute of Kitchen, Bedroom & Bathroom Installation. Membership is confirmed, in writing, including details of a membership number and future expiry date.

2. Membership fees

2.1 Membership fees are published on our website and are subject to VAT at the standard rate at the point of payment.

2.2 BiKBBI reserve the right to increase or decrease membership fees. You will be informed of any fee increase or decrease via our website or through relevant communication channels. Any increase in membership fee will not affect your current subscription.

2.3 Membership fees are agreed in advance of membership and are paid for, either in full, or by spreading the cost via interest free monthly Direct Debit instalments.

2.4 If opting to pay by Direct Debit, applicants agree to additional the terms of our Direct Debit scheme, as follows:

2.4.1 Direct Debit is an easy way to spread the cost of your BiKBBI annual membership fee. By choosing to pay by Direct Debit, you are agreeing to pay the full annual membership fee and as such are bound by this agreement and there Terms & Conditions of Membership;

2.4.2 If you cancel your membership before your expiry date, or before we have collected your final Direct Debit instalment for membership, you are contractually responsible for payment of the remaining balance and any fees as detailed within the schedule below;

2.4.3 In the event your bank returns your Direct Debit unpaid, we reserve the right to request payment of the full balance of your annual membership fee, including any bank charges imposed as per the schedule below. Your BiKBBI membership / association may be suspended or cancelled in this event and until the matter is resolved / balance payment is made;

2.4.4 Paying by Direct Debit will enable the BiKBBI ‘Auto Renew’ process upon expiry of your first year’s agreement, and subsequent annual expiries thereafter. This means that your membership / association will be automatically renewed when your renewal date is reached. The BiKBBI will inform you in writing of your renewal date and your right to cancel the renewal of your membership / our association at least 7 days in advance of this date.

2.4.5 In the event you do not wish to renew, you must inform the BiKBBI no later than 14 days prior to your expiry date. If you fail to inform us within this 14 day period, charges may apply.

2.4.6 The Direct Debit Guarantee governs all Direct Debits. Details of which can be found on your mandate, which should be kept safe for your records.

2.4.7 Direct Debit schedule of fees: Upon initial setup, a £25+VAT is applicable for all new applications. This is a one-off fee that will not be collected for subsequent annual membership renewals; There is no interest to be paid in addition of your agreed membership fee, if choosing to pay by Direct Debit; In the event your bank returns our Direct Debit request unpaid, for whatever reason, a £15+VAT charge is applicable to cover our costs. This fee is in addition to the monthly instalment missed; In the event you cancel your Direct Debit instruction, before the agreement concludes, you will be liable for a £25+VAT early termination fee unless full payment of outstanding membership fees are received within 7 days of cancellation.

2.4.8 We use a third-party provider, Fastpay Limited, for our Direct Debit facility. By opting to pay by Direct Debit, you agree that we pass selected personal data to this provider, for the purpose of collecting your membership fees. Fastpay Limited are regulated by The Financial Conduct Authority. 2.5 If we discover an error in the price of your membership fee, we will inform you as soon as is reasonably possible. If you discover any error in membership payment you should inform us immediately.

2.6 Fees published on our website are for individual members only. Different fees will apply for corporate arrangements. For further information, please access the corporate membership section on our website.

3. Membership packages, benefits & offers

3.1 As a member, you will receive a range of benefits as part of your membership to us. Details of these benefits can be found on our website.

3.2 We reserve the right to amend the benefits and offers that apply to our membership packages at any time and without prior notice. Changes will be published on our website.

3.3 Any services provided by an external provider are subject to the provider’s own terms and conditions, and we do not accept any responsibility or liability for loss or damage suffered as a result of a fault, error or omission in the provision of these services.

3.4 We reserve the right to adapt and update our links with external providers without prior notice.

4. Membership retention

4.1 Your commitment as a member of The British Institute of Kitchen, Bedroom & Bathroom Installation is as follows:

4.1.1 Members are expected to maintain high standards in relation to workmanship, commercial transactions and conduct. Members are not only bound by their statutory legal obligations, but also by our Members Code of Conduct. We reserve the right to amend this Code of Conduct at any time, without notice. The most updated version will be found online and will supersede any printed version.

4.1.2 Members must ensure that their personal data is updated regularly and that any changes to information or circumstances are reported to us at the earliest possible opportunity, either via the members online portal, or by contacting us in writing (details below).

4.1.3 Membership is not only subject to our entry criteria at the point of application, but also our members continuous maintenance of this criteria throughout their membership with us. This criterion includes, but is not limited, to the provision of certain compliance information including insurance, health & safety, qualifications, Continual Professional Development (CPD) and adherence to local, national and international regulation.

We will provide periodic reminders to support our members meet this obligation. This will include a digital countdown to the expiry of any compliance requirement. Members are advised to submit documentation promptly to avoid any disruption to their membership with us.

4.1.4 Members commit to making prompt payment of agreed fees upon request.

4.1.5 If you membership is granted, but it subsequently transpires that any or all of the information provided by you was misleading or false, we reserve the right to revoke your membership with immediate effect, without the right of appeal.

4.2 In the event members fail to meet their obligations set out within these Terms & Conditions, we reserve the right to suspend / terminate membership, with immediate effect.

4.3 We accept no responsibility for any losses, incurred by any party, if membership is suspended or cancelled as a result of a breach of these terms and conditions.

5. Membership renewals

5.1 30-days prior to your membership expiring we will make you aware that your subscription is due for renewal. At this point you will be asked to confirm your personal details. You will have a maximum of 14 days to respond to the renewal enquiry notice. If you do not respond within 14 days and then decide to renew your membership you will be invited to reinstate your membership.

5.2 Your renewal payment is confirmation of the continued acceptance of this contract.

5.3 You may not transfer any of your rights and obligations under these terms and conditions to another person.

5.4 Any payment arrangements that have been made by Direct Debit will automatically continue unless you notify us and your bank / building society that you wish to cancel it.

5.5 If you wish to cancel your membership, you must inform us of your intention to cancel a minimum of ten working days prior to the expiry of your subscription. This notice should be provided directly to us, in writing by letter or email.

5.6 No refunds of membership fees will be provided unless the notice requirements are complied with.

6. Cooling off period: New member applications 

6.1 If you decide not to proceed with your membership application a 14-day cooling off period will apply, calculated from the day payment is received by the BiKBBI. If you wish to cancel your application, you must notify us within these 14 working days in writing, by email or letter.

6.2 The cost of postage and packing applicable to the return of the membership will be at your own expense and we will not be held accountable for any related administration or postage costs.

6.3 Refunds will not be made outside this 14-day period.

7. Cooling off period: Renewals

7.1 If you decide not to proceed with your membership renewal or re-instatement a 14-day cooling off period will apply. If you wish to cancel your renewal subscription, you must notify us within these 14 working days in writing, by email or letter. If a membership pack has been issued, this must be returned to us before any refund is made. If this pack is not returned, we reserve the right to withhold fees paid.

7.2 The cost of postage and packing applicable to the return of the membership will be at your own expense and we will not be held accountable for any related administration or postage costs.

8. Marketing & communications

8.1 On applying to become a member you agree to notify us of any change in your personal circumstances including name, home/work address and e-mail. We are not responsible for any failure, delay or non-receipt of e-communications or written communication.

8.2 We reserve the right to dispose of any incorrectly addressed packages and their contents without an obligation to refund your membership fee if they are returned to our office.

8.3 Neither party shall be liable to the other for any delay or non-performance of its obligations by reason of matters beyond its control including, but not limited to, any act of terrorism, war, riot, civil commotion, compliance with any law or government order, fire, flood or storm, strikes, or any other industrial dispute, delay in transit, power failure, postal delay, or any event that cannot be reasonably be planned for or avoided.

8.4 During the application process, you will be asked to opt-in to communications from us. We use this contact information to manage document compliance and send details of updates, news and other relevant information. We do not share data with any third party (see 9).

9. Data Protection & use of Personal Data 

9.1 To the extent that we process any personal data relating to you, we will process that data in accordance with applicable law and our Privacy Policy and will implement and maintain appropriate technical and organisational security measures against unauthorised or unlawful processing of that personal data and against its accidental loss, damage or destruction.

9.2 For the purposes of these terms and conditions, the terms “process” and “personal data” shall have the meanings given them in the General Data Protection Regulation (2018).

9.3 If you wish to obtain a copy of your personal data held by us please follow instructions as directed within our Privacy Policy. In accordance with our legal obligations, there is no charge for this request.

10. Verification

10.1 We will comply with all verifications of membership by third party organisations only if consent has been provided by you.

11. Data protection via the website 

11.1 Please refer to our Privacy Policy.

12. Events

12.1 As a member you may be invited to events organised by us or by our partners. You are not obliged to attend.

12.2 Cancellations made 14 days or more before any chargeable event will be refunded in full. Cancellations after that date will be charged in full, although substitute attendees can be made at any time. Non-attendees will still be charged the full rate and no refunds provided.

12.3 Conferences will be subject to separate terms and conditions. Please check these at the time of booking.

13. Contract variation

13.1 We may change these terms and conditions at any time upon giving you 14 days prior written notice. The most recent edition of these terms and conditions will be binding upon you.

14. Governing law & jurisdiction

14.1 These terms and conditions are governed by English law. You hereby irrevocably submit to the exclusive jurisdiction of the English courts notwithstanding the jurisdiction where you are based.

14.2 If any court or competent authority decides that any of the provisions of these Terms are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

15. Third parties

15.1 A person who is not party to these Terms shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.

16. BiKBBI logo

16.1 Use of our logo is only permitted for current members in accordance with our published logo guidelines.

16.2 Applicants who have not yet received their members welcome pack, including ID card and accreditation certificate and those members whose membership has been cancelled or expired are not permitted to use the BiKBBI logo or reference to BiKBBI membership.

17. Entire agreement 

17.1 These terms and conditions override any contrary terms or conditions published by us in relation to any membership subscription.

18. Changes to these terms and conditions

We keep our terms and conditions of membership under regular review.
